These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Madcarons, doing business as Madcarons.co ("Madcarons.co", “we”, “us”, or “our”), concerning your access to and use of the http://www.madcarons.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”). You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms of Use.

 

PRICING

All prices are stated in Malaysian Ringgit (RM).

 

ALLERGIES TO INGREDIENTS 

All our macarons contain eggs, almond and dairy products. They are not gluten free. Our macarons may not be suitable for those who are lactose intolerant, have allergy reactions to gluten and nuts.

DELIVERY TERMS

Delivery arrangements are made via a third party service and charges are fixed at an estimated amount, depending on the distance between our workshop and the recipient's destination.

Delivery arrangements will only be scheduled once full payment has been made.

One delivery arrangement is confirmed, it is important to ensure that the recipient or representative is available to receive the product. Failure to collect the product from the courier will result in the product being returned to Madcarons, without refunds.

 

DAMAGES

Madcarons will not be held liable for any damages to the product during the delivery process.

 

STORAGE AND CONSUMPTION 

We recommend that our products are best consumed within 48 hours after collection and/or delivery. Additionally, our products can be chilled or kept refrigerated for up to three days.

All of our products will need to be stored in the refrigerator and brought back to room temperature before consuming.

 

CANCELLATION AND REFUND

Any cancellation is possible so long as it is three (3) days prior the scheduled pickup and/or delivery date. Refunds will be provided in the matter of days depending on your bank / card issuer.

 

CUSTOMER COMPLAINTS

Madcarons is committed to delivering exemplary and professional customer service.

Therefore, customers may Whatsapp their complaints and woes pertaining our products and/or services to 018-2021050, and we will do our utmost best to attend to them accordingly.

We also welcome feedback that will also help us in improving our business.

 

INTELLECTUAL PROPERTY RIGHTS

The Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of Malaysia.

Except as expressly provided in these Terms of Use, no part of the Site and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

Provided that you are eligible to use the Site, you are granted a limited license to access and use the Site and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use. We reserve all rights not expressly granted to you in and to the Site, the Content and the Marks.

 

PRODUCT DESIGN INTEGRITY DISCLAIMER

Customers may contact us to share photo samples of their desired designs, however, all designs are subject to the artistic expression of Madcarons. Pictures are served for illustration reference purposes ONLY.

While all our products are home baked and handmade, some decorating elements are dependent on their availability such as seasonal fruits and edible flowers.

We will not be able to replicate another vendor's macaron product or samples due to artistic rights.
